We will introduce you to local customs as well as legal options.
Buying real estate in Thailand does not require physical presence when signing the contract.
In the case of an investment intention, we will provide you with a calculation of rental profits and a good return on investment.
RESERVATION AND RESERVATION FEE
The reservation contract serves to reserve the property and withdraw the selected property from sale. The amount of the deposit is 10% of the total purchase price. The reservation contract contains basic details: purchase price – financing in tranches, date of signing the purchase contract, complete data on the property and data of the contracting parties and the date of handing over the property. Clients can sign the Reservation Agreement at our office in person, online or at the place where the villa is being built.
Payments are made via the IBAN of our company in Slovakia.

WAYS YOU CAN OWN LAND IN THAILAND
When it comes to land ownership, only Thai citizens can own it directly in their name. Foreigners can own a house or building, but not the land itself. Foreigners have two options for land ownership: renting through a legally recognized lease at the Land Office or owning it through a Thai company that holds the land as an asset. Your choice will depend on your specific situation and preferences.
LAND RENT
This is the most common way of owning land in Thailand. In this situation, the land where your house is located is owned by a Thai citizen or a Thai entity. When you buy a property, you create a 30-year lease with the landowner, which is recorded on the land title deed, known in Thai as a “Chanote”. This land lease agreement, called the Land Lease Agreement (LLA), is officially recognized by the Thai government. It ensures that the landowner cannot cancel or interfere with your right to use the land during the lease term. Thai law so far only allows the maximum lease term of 30 years to be officially registered at the land office. This 30-year lease is a guaranteed right protected by the Thai government. You, as a tenant, have the legal right to use the land, and no one can deny you access or use of the land during this lease period. In addition, you have the right to transfer or lease the land to anyone without the prior consent of the owner of the land.
FREEHOLD
Usually only Thai citizens can own land in Thailand. However, if you are a foreigner and want to own a house and land without restrictions, there is an option. You can buy land through a Thai company. Here’s how it works: A lawyer helps you set up a Thai company where you become the majority shareholder and manager of the company. Foreigners can own up to 49% of the company, with the remaining 51% owned by at least 2 Thais. Even if you are a foreigner, you can still have majority ownership and control of the company as its chief executive and sole decision maker. Many foreigners prefer this method of company ownership because they believe it offers better protection and real ownership rights compared to land leases. However, as a company owner, you will need to file annual taxes and prepare financial statements, which will require the help of an accountant, costing approximately 12,000-20,000 THB per year. It is important that you do not use this company for business activities, as it can complicate your tax situation when you decide to sell the property later.

Koh Samui has a tropical climate that ensures a stable temperature throughout the year. The temperature on Koh Samui is around 30 °C, or more throughout the year. The climate is slightly different from that of the rest of Thailand. Monsoons occur on Koh Samui at a time when the rest of the country is enjoying a dry spell. Monsoons are typical from November to December and the driest months are January to March.

VISA IN THAILAND
Loven citizens entering Thailand for the purpose of tourism are exempt from the visa requirement for a maximum of 30 days.
A visa is required to enter and stay in Thailand for other purposes and to stay for the purpose of tourism for more than 30 days. Slovak citizens can apply for Thai visas before departure, e.g. at the Embassy of the Kingdom of Thailand in Vienna.
Citizens of the Slovak Republic can enter Thailand without a visa through the land border crossing only twice during the calendar year. It is only possible to extend the stated period of stay to a limited extent.
Information on applying for an extension of the permitted period of stay can be found on the website of the Thai Immigration Office.
Passport validity
When entering Thailand without a visa, the passport must be valid for at least 6 months before it expires. If a damaged or defaced passport is presented, the holder may be refused entry to the country.
It is not possible to enter Thailand on a replacement travel document, it is only used for departure from the country in case of lost or stolen passport.
Financial security
Entry to Thailand may also be subject to the condition of proving sufficient financial security for the stay, proof of accommodation and a return ticket, or departure from the country. Foreigners must prove funds in the amount of THB 20,000 when requested – or equivalent in other currency in cash or 40,000 THB/equivalent in case of traveling family.
Exceeding the permitted period of stay
In the case of exceeding the permitted period of stay in Thailand, the violator faces a monetary fine (THB 500, for each day of exceeding the permitted length of stay, max. THB 20,000), and the violator is exposed to the risk of detention and subsequent deportation.
The period of stay in the detention center is not limited in time. The detainee is obliged to secure a return ticket to the Slovak Republic at his own expense and to pay the imposed monetary fine. In the event of a serious violation of legal regulations regarding residence, a court decision may impose a penalty of banning entry to the territory of Thailand for a period of up to 10 years.
To a foreigner who voluntarily informs the Thai immigration office that he has exceeded the length of his authorized stay in Thailand:
for more than 90 days will be subject to a 1-year ban from entering the country, starting from the date of his departure from Thailand.
in more than a year, he will be banned from entering the country for 3 years, starting from the day he left Thailand.
for more than 3 years, he will be banned from entering the country for 5 years, starting from the date of his departure from Thailand.
for more than 5 years, he will be banned from entering the country for 10 years, starting from the day he left Thailand.
In the case that a foreigner was arrested or a criminal prosecution was initiated against him and at the time of arrest or initiation of criminal prosecution he was staying in the country illegally, i.e. j. has exceeded the permitted period of stay by less than or exactly one year, he will be subject to a 5-year ban on entry, starting from the date of his departure from Thailand.
If he was staying in the country illegally at the time of arrest or prosecution, i.e. j. has exceeded the permitted period of stay by more than a year, he will be subject to a 10-year ban on entry, starting from the date of his departure from Thailand.
Registration obligation
In Thailand, registration is required within 24 hours of entering the country. It is registered at the immigration office according to the place of residence or at the local police department. The owner of the accommodation facility fulfills this obligation for foreigners.
LONG TERM VISAS OPTIONS IN THAILAND
After you have a short-term visa and want to stay in Thailand longer or even want to live in the country, it is ideal to consider the options you have for a long-term Thai visa.
Long-term visas can be difficult to obtain as there are many available. However, understanding what they are can point you in the right direction. Then you can look for insurance for moving your belongings and furnishing a house or apartment in this beautiful country.
Educational visa
Thai education visas are granted to those who wish to study at university, attend seminars, do internships or receive training in Thailand. Generally, the holder must stay in the country for 90 days. In addition, the visa can be extended by one year from the first date of entry.
Since this is considered a non-immigrant ED visa, you must send the application to an out-of-country consulate or Thai embassy. Before you can do so, you should enroll in a government-recognised full-time training course. It must meet visa requirements and you must pay 50 percent of the total cost.
After registration, the institution must provide you with the necessary papers to submit the application. He can often send it directly to where you submit your application, and it usually takes four to five business days.
Under the ED visa, you must report your current address to the immigration office in Thailand every 90 days. It can be done by post, through a proxy (power of attorney) or in person at the office.
Business visa
If you are opening a company or applying for a job in Thailand, you need a business visa. It is best to get it before visiting the country. You can also extend it to a long-term visa through the local immigration office.
There are two different categories for foreigners:
Business
- Non-immigrant means you are running a business or starting a company. You have a 90-day visa (single entry) issued in your home country that allows you to stay in Thailand for 90 consecutive days.
- Then there’s the one-year nonimmigrant visa. This is given to those who do business in Thailand but frequently travel in and out of the country. Once your work permit is processed, it will be extended to a visa. However, you must obtain sponsorship from a company or entity in Thailand for these purposes.
Employment
If you plan to work in Thailand, you need an initial 90-day nonimmigrant visa (B) from your home country.
Your potential employer (in Thailand) must sponsor your visa application.
The application for a work permit is processed during these 90 days.
Once you have a valid work permit, you can apply for a one-year nonimmigrant visa extension and continue working for that company.
You usually have to report your address to the Thai immigration office every 90 days. Whenever you travel outside of Thailand, you must obtain a re-entry permit in order to return.
Follower Visa
The follower visa is a bit different from the others. This often involves the spouses or children of someone on a retirement visa or an expat working in Thailand. In a sense, you want to live there, and then your children or spouse will arrange for you after everything.
In general, children must be under the age of 20 to apply for a successor visa. However, there is no age limit for spouses. This usually only works great if you plan to live in Thailand for a long period of time (one year or more). Otherwise, spouses and children can often receive regular short visas for holidays and visits to your home.
Elite Visa
The Thai elite have just announced changes! Current Elite visas will be canceled and new visas will be offered in October!
The elite visa is granted to Thailand Privilege Card members and is a long-term option. It is categorized according to tourist visa or privileged entry visa which allows stay in the country along with specific benefits for five, 10 or 20 years. Overall, it depends on the package you choose and the membership fee you pay.
The Elite Visa is a five-year multiple-entry visa that is renewable and can be extended by one year per entry. If you have a membership for 10 to 20 years, this five-year visa is granted every five years.
Holders of such a visa can enjoy a continuous stay in the country. In a sense, they don’t have to leave every 90 days, as other types of visas require.
You are actually represented by Elite staff when it comes to reporting every 90 days as Thai immigration still requires it. Generally, holders get expedited passport processing and immigration formalities on arrival in Thailand, making it the best choice for many people.
In Thailand, the royal family is shown great respect and any insult or criticism of the royal majesty is severely punished. Violators of the so-called law lese majesté are subject to a prison sentence of several years.
Thailand is a predominantly Buddhist country. Those who commit desecration of the Buddha in any form (e.g. painting, statue) are threatened with imprisonment. When visiting Buddhist monuments and temples, visitors must wear covered shoulders, long pants and appropriate footwear, which must be removed before entering the temple itself.
In Thailand, there is a high risk of traffic accidents and in accident and death statistics due to the number of traffic accidents. The largest part of traffic accidents and injuries is caused by drivers of motorcycles and scooters. The Embassy of the Slovak Republic in Bangkok points out that on the territory of Thailand you drive on the left side of the road. Those interested in renting a motor vehicle or motorcycle must have a valid international license indicating the correct vehicle category and a national driver’s license. When renting motorcycles and scooters, we recommend using the services of reputable rental companies. Driving a motor vehicle under the influence of alcohol is fined and in the case of causing a traffic accident under the influence of alcohol is punishable by imprisonment.
Drugs of any kind are prohibited in Thailand. Possession of even a very small amount can lead to imprisonment. In the case of possession and trafficking of class A drugs (amphetamines, ecstasy, heroin, cocaine) you risk high penalties, up to the death penalty.
As of June 9, 2022, the private recreational use of cannabis is legal if the THC content is less than 0.2% by weight, but the use of cannabis in public places remains prohibited. If you are not an authorized person and do not meet the conditions for cultivation, consumption, distribution and sale of cannabis products, you are still at risk of severe punishment.
It is illegal to bring more than 200 cigarettes per person into Thailand. Those who exceed the limit can be fined ten times the value and face confiscation of cigarettes. The control is carried out by customs officers upon arrival in the country.
Smoking in public is prohibited (except in designated areas) and may result in a fine of up to 5,000 THB. This also applies to e-cigarettes, which are illegal in Thailand and use can result in additional fines or imprisonment.
CUSTOMS REGULATIONS
What can be imported and exported for personal consumption
Items of a personal nature of a non-commercial nature with a reasonable value (there is no need to declare them), but no more than 20,000 THB (approx. 500 euros), are not subject to customs procedures, while they must not be items whose import and export are prohibited by Thai legal regulations or items whose import or export is possible only on the basis of a special permit issued by the relevant Thai state authority.
Items of a personal nature exceeding 20,000 THB (approx. 500 euros), e.g. consumer electronics, watches, jewelry must be declared when entering and leaving Thailand, but they are not subject to customs duty. It must be used things.
Import of a maximum of 200 cigarettes or 250 g of tobacco products, max. 1 liter of wine or spirits is not subject to the customs procedure. Exceeding this amount is subject to confiscation of the goods and a fine (must not exceed four times the value of the goods) or imprisonment.
The goods whose import and export are prohibited include, for example: statues of Buddha, antiques, short-wave radios, weapons, drugs, pornographic material, counterfeit consumer goods, counterfeit banknotes and coins, protected animal and plant species and their products. In case of violation of this regulation, a high fine and confiscation of the goods are likely). Narcotics smuggling is punishable by death.
Strict laws and high penalties
Please note that there are very strict laws governing the smuggling, sale and possession of narcotics of all kinds, as well as very strict penalties, including the death penalty, in case of violation.
The penalty for possession of marijuana can be up to 15 years in prison and a fine of THB 150,000. Amphetamines and Ecstasy are regulated in the same way as class A drugs and carry the same penalties as heroin. Possessing as little as 20 grams of Class A narcotics when leaving Thailand is considered illegal narcotics trafficking, and the death penalty can be expected if found guilty.
There are no restrictions on the import of Thai currency. Imports of foreign banknotes and coins exceeding the value of USD 20,000 or the equivalent must be declared.
Exports of Thai currency of THB 50,000 or more must be declared. It is possible to export max. 500,000 THB. Exports of foreign banknotes and coins exceeding the value of USD 20,000 must be declared.
When importing pets (dogs, cats, max. 3 pcs.), the Thai authorities may impose a 30-day quarantine in order to verify the animal’s health at the owner’s expense. Animals do not have to be microchipped, but Thai authorities recommend it. It is mandatory to submit a veterinary certificate in English about the state of health and completed vaccinations. Thai authorities may also require proof of ownership and pedigree of the animal. The importation of the American Pit Bull Terrier and the American Staffordshire Terrier is prohibited.
INFORMATION FOR MOTORISTS
In Thailand, you drive on the left. Road traffic rules are officially valid in the country, which, apart from the basic rules, few people respect. Pedestrian crossings are particularly dangerous in cities, where frequent accidents occur due to their frequent disregard.
When driving a motor vehicle, it is necessary to have an international driver’s license with you. Due to frequent motorcycle accidents, insurance companies do not insure injuries caused by a motorcycle accident. There is a high risk of traffic accidents in Thailand, the country leads in accident statistics and deaths due to the number of traffic accidents. The largest part of traffic accidents and injuries is caused by drivers of motorcycles and scooters.
From September 5, 2022, all vehicle occupants, including rear seat passengers, must wear seat belts. Under the new traffic law, you can be fined up to 2,000 baht if you don’t comply.
According to Thai law, you must wear a helmet when riding a motorcycle.
Renting motorcycles and scooters
Those interested in renting a motor vehicle or motorcycle must have a valid international driver’s license indicating the correct vehicle category and a national driver’s license. When renting motorcycles and scooters, we recommend using the services of reputable rental companies.
Cheaper rental companies often rent motorcycles and scooters that are not registered and therefore their use on public roads is prohibited. When concluding contracts for the rental of a motorcycle or scooter, it is necessary to check whether the price also includes insurance in case of a traffic accident.
We recommend that you also obtain photo documentation of the condition of the rented means of transport, as the rental company may charge a several times higher price for damage when returning motorcycles. Wearing a protective helmet while driving is mandatory and failure to comply with the said regulation is fined by the police. Please note that the management of Quad-bikes, the so-called ATVs on public roads in Thailand are prohibited. Driving a motor vehicle under the influence of alcohol is fined, and in the case of causing a traffic accident under the influence of alcohol, it is punishable by imprisonment.
When renting motorcycles, we do not recommend handing over your passport or personal documents as a deposit, even though it is a frequent request from insurance companies. These documents can be misused to recover financial payments.
Special attention it is necessary to pay attention to the condition of cars, motorbikes and jet skis when renting them (scratches, damage, etc.). Before using motorboat transport, it is necessary to make sure that all safety regulations are followed and that life jackets are available.
HEALTH CARE
A vaccination certificate is required only from persons coming from areas of infectious diseases. The Slovak Embassy in Bangkok recommends vaccination against hepatitis A and B, tetanus and the use of antimalarials (if the traveler is traveling to border areas in the south and north of the country).
The quality of medical services is good, private medical facilities have a high level. Medical services are paid for, there are no free services. Tourists are therefore advised to get insurance before traveling to Thailand.
CLIMATIC CONDITIONS
Thailand is located in a tropical region, the average annual temperatures range from 28°-38°C, air humidity is usually between 50 and 85%. The three seasons can be divided into: warm – from the beginning of March to the end of May; rainy – from the beginning of June to the beginning of October; mild – from mid-October to the end of February.

ADVICE AND RECOMMENDATIONS
As of November 2017, smoking is prohibited on beaches in some tourist areas including Koh Samui, Pattaya and in the provinces of Phuket, Prachuap Khiri Khan, Chon Buri and Songkhla. These are the most famous beaches which include Mae Phim in Rayong; Laem Sing in Chanthaburi; Bang Saen, Pattaya and Tham Pang on Koh Si Chang in Chon Buri; Cha-am in Phetchaburi; Hua Hin and Khao Takiap in Prachuap Khiri Khan; Patong in Phuket; Bo Phut on Koh Samui in Surat Thani; Sai Ri in Chumphon; Chalatas in Songkhla; Tha Wa Sukri in Pattani; Koh Khai Nok, Koh Khai Nai on Koh Yao in Phangnga, Phra Ae and Khlong Dao on Koh Lanta in Krabi. Those who violate the said ban face a fine of up to 100,000 THB or imprisonment for a period of one year.
Since February 2019, a smoking ban has also been introduced in 90 public places, including areas of official buildings, hospitals, school facilities, shops and shopping centers, public transport stops, condominiums, hotels, swimming pools, cinemas, etc. Areas within a radius of 5 meters from the entrance and exit areas of buildings are also considered non-smoking zones. The smoking ban also applies at 6 international airports – Suvarnabhumi, Don Mueang, Phuket, Chiang Mai, Hat Yai and Mae Fah Luang, where smokers no longer have designated smoking areas inside the airports. smoking is only allowed in designated outdoor areas. Violators face a fine of THB 5,000.
According to the relevant Thai legislation, the import, export, transport, storage and use of electronic cigarettes and their analogues and refills are prohibited. The use of hookah is also prohibited. The penalties are relatively high, violators face a large fine and several years in prison. It is allowed to bring in 200 cigarettes or 250 grams of rolled tobacco or cigars or a combination of rolled tobacco and cigars with a total weight not exceeding 250 grams. The importation, possession, sale or use of any drug is strictly prohibited in Thailand and the penalties in this area are high, including life imprisonment. Amphetamines and ecstasy are regulated in the same way as class A drugs and carry the same penalties as heroin. Possession of as little as 20 grams of Class A narcotics is considered illegal drug trafficking and a death sentence can be expected if found guilty.

We recommend rejecting the purchase of precious stones or other products offered on the beach and on a credit card, with the purchase delivered to the buyer’s home address, in most cases the delivered stones do not have the value that the tourist will pay for them, and refunds are almost impossible, as stores often change your address, or they don’t exist at all.
In Thailand, the use of drones that are not registered in advance is prohibited. Drones that will be used for commercial purposes must be registered in advance and insurance must be presented. Strict rules apply to the use of drones.
